Information Requirements for Service Providers

Service providers must provide consumers with the following information in a comprehensible form prior to signing a written contract or, if a contract is not concluded, before delivering their services:

  • Their surname and first name(s), or in the case of legal partnerships and legal entities, the company name and its legal form.
  • Their business or branch address or, if no such address exists, a valid address under which they can also be summoned by a court, as well as other information enabling the recipient of the service to communicate quickly and directly with them, especially a telephone number and an email address or fax number.
  • The Company Register, Register of Associations, Register of Partnerships or Cooperative Register in which they are registered (if any), including the register court and registration number.
  • In the case of licensed occupations, the name and address of the licensing authority or body.
  • Their value added tax identification number pursuant to Section 27a UStG VAT Act (if they have one).
  • In cases of the exercise of a regulated profession within the meaning of Article 3 (1) (a) Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the Recognition of Professional Qualifications (OJ L 255, 30.9.2005, p. 22), their statutory professional title, the state in which it was awarded, and, if the service provider belongs to a professional chamber, association or similar body, its name.
  • The general terms and conditions of business used by them.
  • The contract clauses used by them regarding the law applicable to the contract or jurisdiction.
  • Intended warranty promises extending beyond the statutory warranty rights.
  • The essential characteristics of the service if not already apparent from the context.
  • Details of professional liability insurance (if taken out), especially the name and address of the insurer and its geographical scope.

 This information is optionally:

  • To be voluntarily provided to the service recipient.
  • To be displayed at the place where the service is delivered or the contract is concluded such that it is easily accessible to the service recipient.
  • To be made easily available electronically to the service recipient via an address specified by them.
  • To be included in all detailed literature on the service offered provided by them to the service recipient.
